WASHINGTON (AP) - The yard signs are printed and the candidate is wearing out the campaign trail, but Alabama Democrat Artur Davis says he's not running for governor - legally at least.

That was the explanation from the campaign Thursday about whether Davis is living up to an ethics pledge to delay spending from his leftover congressional account until June 1, when Alabama candidates can begin fundraising.

Davis, a three-term congressman from Birmingham, made the commitment after his February gubernatorial announcement.

But congressional finance reports show he has spent $120,477 through March on campaign expenses.

His spokeswoman said the spending is consistent with Davis' pledge because he hasn't technically formed a gubernatorial committee.
