Alabama man indicted in Ga. Waffle House death

COLUMBUS, Ga. (AP) - An Alabama man has been indicted in an attack outside a Columbus Waffle House that killed a former Lee County deputy.

Officials say 22-year-old Dustin Ray Horton of Seale, Ala., was indicted on a murder charge Tuesday.

He's accused of hitting 36-year-old Scott Jeremy Drago in the restaurant's parking lot on June 28. Drago fell and fractured his skull on the pavement and was pronounced dead later that night.

Horton was with a group in the parking lot when Drago and a friend pulled up. Horton's group had to move before Drago could park and Horton claimed he was nearly run over.

The men argued but reconciled after talking about Drago's truck, sports and learning they both were in the National Guard.

Police say Horton later lured Drago out from the restaurant and struck him without warning.
