MONTGOMERY, AL (WSFA) - After nearly a month in the hospital a Montgomery man is being released into police custody.

Tremane Carthen, 29, was hospitalized on February 22, 2009 following what police call an "intentional vehicle accident" that killed his brother.

Carthen was driving down the Mobile Highway near the Catoma Creek when police say he tried to strike another vehicle. Instead, the man lost control of his own car and slammed into a guardrail.

Eric Carthen, Tremane's brother, died of injuries sustained in the crash a short time later at Baptist Hospital South.

With the hospital release comes charges. Carthen now faces two counts of Attempted Murder and one count of Reckless Murder.

He's being held at the Montgomery County Detention Facility on $195,000 bond.
