Jeff co. judge rules in favor of sheriff

Birmingham, Ala. (WSFA) -- A judge has ruled the Jefferson county commission does not have the authority to cut the sheriff's budget by $5 million.

For now the money is being held and both sides ordered to continue negotiating before reporting back to court next week.

Meanwhile Governor Bob Riley says the request to declare a state of emergency for financially strapped Jefferson county is not a legal option.

Officials say they have the money to meet this months payroll, but may not for August.
