MONTGOMERY, AL (WSFA) - A mistrial was declared on Friday in the capital murder trial of Daoud Boone. Boone was accused of shooting and killing Sylvia Perry in 2007.

Officials tell WSFA 12 News a jury in the capital murder trial was unable to reach a verdict on the murder charge.

Boone's attorney, Julian McPhillips tells WSFA 12 News he is pleased with the jury's outcome. McPhillips stated "we're very encouraged and consider it of a real victory when you have a hung jury in capital murder case, its shows there is a lot of doubt." He maintains his client's innocence.

The district attorney will reschedule a new trial on the murder charge.

Boone was found guilty for a drug charge associated with the case.
