Schmitz again seeks to delay start of sentence

BIRMINGHAM, Ala. (AP) - Former Democratic state Rep. Sue Schmitz has again asked a federal judge to delay the start of her federal prison sentence for a fraud conviction.

Schmitz of Toney has been ordered to report to federal prison on Dec. 30.

An earlier motion asking that her sentence be delayed while her conviction is appealed to the 11th U.S. Circuit Court of Appeals. She filed a new motion Thursday asking U.S. District Judge David Proctor to delay her sentence while the appellate court considers her motion seeking an appeal bond.

Schmitz was sentenced to two and a half years in prison after being convicted in February on charges that she used her influence as a legislator to get a job in the two-year college system and then did little work.
