MONTGOMERY, Ala. (AP) - A Montgomery judge has rejected a lawsuit by Alabama Supreme Court Justice Tom Parker that sought to remove one of his opponents from the Republican primary.
Circuit Judge William Shashy ruled against Parker's claims that Birmingham attorney Eric Johnston should be disqualified for being late filing two documents. They were a financial statement with the Alabama Ethics Commission and a campaign committee statement with the secretary of state's office.
Shashy issued a ruling late Monday afternoon saying lateness does not warrant disqualification.
Johnston blamed the delay on a delivery service. Wetumpka attorney James Houts is also running in the Republican primary on June 1.
