Ala. judge declares mistrial in 4-murder case

BIRMINGHAM, AL (AP) - Jefferson County Judge Mac Parsons declared a mistrial in the trial of 20-year-old Shaunasty Lowe on quadruple murder charges after learning there had been discussion of the case involving at least three jurors.

Lowe, of Birmingham, is charged with the July 24, 2008 deaths of Derrick Witherspoon, Elizabeth Witherspoon and her sons, Justin and Jerome McFarland.

All four were shot, but testimony in the trial which began this week indicated the boys died from a combination of smoke inhalation and gunshot wounds. Birmingham police say the house was set on fire after the shooting.

A retrial has been tentatively rescheduled for Sept. 13.
