MONTGOMERY, AL (WSFA) - A Greene County judge is ordering the return of all gaming machines seized by Attorney General Luther Strange's office to the reopened Greenetrack gaming facility.
"We strongly disagree with the Court's findings and characterizations of the State's actions," Attorney General Luther Strange's office said.
Greenetrack's motion questioned probable cause for a search warrant. It accused the law enforcement agent who submitted the affidavit for the warrant of false and misleading information, "made with reckless disregard for the truth."
Judge Brown wrote in his order that the court had serious concerns with the state's evidence for probable cause.
The judge gave the state 10 days to return the property.
