LOUISVILLE (WAVE) - Shackled in Jefferson County District Court, Joushua Gouker faced a judge, again.
Metro police claim the Madison County Alabama Detention Facility accidentally released him. LMPD arrested Gouker on fugitive warrant October 6.
A judge decided to hold off on Gouker's case until October 17.
WAVE 3 tracked down Madison County Chief Steve Morrison from the Alabama jail. Morrison defends his decision to release Gouker.
"Nothing went wrong on our end," Morrison said. "We checked the National Crime Information Computer system and contacted Jefferson and Floyd Counties. The teletype said he wouldn't be extradited so we let him get out."
Gouker's son is charged in the murder of 14-year-old Trey Zwicker. Zwicker was Gouker's step-son.
Police never named Gouker a suspect, but a victim's protection order called him a person of interest in the murder.
Gouker fled to Alabama with his son Joshua Young - who's charged with the crime. that prompted an amber alert.
"We held him, then when he bonded out and had time served for weapons charges the distrcict court also dismissed kidnapping," Morrison said.
Morrison stands by his decision to release Gouker.
"Before he was released we sent out another teletype nothing else popped up. They would not extradite. That cleared the way for him to be released."
Gouker is being held in the Jefferson County Jail.
