Updyke attorney asks judge to drop charges

An attorney for Harvey Updyke is asking a judge to drop some of the charges in the case.

Updyke currently faces two counts of criminal mischief, two counts of damaging a crop at a crop facility, and two counts of desecrating in a public place an object of veneration.

Defense attorneys have filed a motion asking the judge to drop both of the criminal mischief charge, one count of damaging a crop at a crop facility, and both counts of desecrating in a public place an object of veneration.

Updyke is accused of poisoning the historic oak trees at Auburn's Toomer's Corner.
