Harvey Updyke's counsel files motion in case

AUBURN, AL (WSFA) - The legal counsel of Harvey Updyke who is the man charged with poisoning The Toomer's Oak Trees at Auburn University has filed a motion.

The motion is asking for Lee County Circuit Judge  Jacob Walker to recuse himself from the upcoming trial. The reason behind this motion has not been revealed yet.

The court will make the decision on Tuesday the trial as it stands is set for March 5, 2012.
