The driver of a vehicle that crashed into a utility pole Sunday, killing a passenger, is now charged with murder. The Montgomery Police Department charged 52-year-old Johnny Foulks Monday.

Foulks was driving a 1999 Jeep Cherokee around 4:40pm Sunday, but as he entered the intersection of Rosa Parks Avenue and Jeff Davis Avenue, he left the roadway and struck a utility pole.

Saralyn Lewis, 50, was transported to Baptist Medical Center South where she later died of her injuries. Foulks was also transported to Baptist for treatment.

Foulks is being charged with murder because an investigation indicates alcohol was a factor in the crash.

Foulks is being held at the Montgomery County Detention Facility under a bond of $75,000.

Lewis' death is now list as both the city's eighth traffic fatality and fifth homicide of 2012.
