There are new developments in the Dunwoody daycare murder case.

A DeKalb County Grand Jury has subpoenaed videos from Andrea Sneiderman's testimony during the Hemy Neuman murder trial.

Last month, Hemy Neuman was found guilty but mentally insane for the shooting death of Sneiderman's husband, Rusty, outside Dunwoody Prep daycare.

He was sentenced to life in prison without parole.

Prosecutors believe Neuman and Andrea Sneiderman were having an affair, and she may have been involved in her husband's death.

Former DeKalb County District Attorney J. Tom Morgan, who is now a defense attorney, said it's unclear what charges grand jurors are considering since the proceedings are secret.

"From watching the trial,  there could be everything from perjury up to conspiracy to commit murder to parties to a crime to murder," Morgan told CBS Atlanta News. "We don't know."

Morgan said it is unlikely Andrea Sneiderman will be charged with murder or conspiracy.

"I don't think there's anything that occurred during the trial that gives us any more information that would prove guilt beyond a reasonable doubt as to murder."

Morgan said there is likely only one person who knows the truth about the murder, and that is Neuman. 

"The only witness who knows the truth, other than her, is the defendant who's now been convicted," said Morgan.  "But he's been convicted of guilty but mentally ill, so his credibility is shot."   

The district attorney's office refused to comment on the grand jury proceedings and said there is no timetable for jurors to decide whether to hand up an indictment.
