LOUISVILLE, KY (WAVE) - The man behind the wheel during a deadly accident is still in jail after his attorney asked he be placed on house arrest.

Defense attorneys for Michael Penick wanted a decision Thursday morning during a pre-trial conference, but that didn't happen.

Next Wednesday, April 25 a judge may determine if Penick's bond should be increased or if home incarceration is a better option.

Police say Penick, 29, hit and killed a 7-year-old girl last week. Officers cited Penick for not having insurance and operating on a suspended license.

Since the deadly accident, he's been in jail for violating the Home Incarceration Program, managed by Metro Corrections. At the time of the crash Penick was out on bond for several felony charges, including burglary.

"The Commonwealth certainly objects it," said Assistant Commonwealth Attorney Cristal Fox. "He's the poster child for someone who shouldn't be on HIP."

Penick's attorney wasn't available for comment.
