A doctor says the man accused of poisoning the oaks at Toomer's Corner is in need of medical attention.
Friday morning, Harvey Updyke's attorneys filed a notice at the Lee County Courthouse that may affect whether or not he can participate in next week's trial.
The notice cites Updyke's medical condition requires him to undergo neurological evaluation for passing out spells. It also mentioned the defendant's "fragile state" and "his poorly controlled diabetes".
His trial is set for Monday, June 18. Updyke has pleaded not guilty to charges including felony criminal mischief.
