BIRMINGHAM, AL (WBRC) -
A Montgomery U.S. District Judge has ruled against a new trial for former Alabama Governor Don Siegelman.
Judge Mark Fuller issued his opinion Thursday. Siegelman's attorney was challenging Siegelman's conviction on bribery and conspiracy charges on five issues:
(1) Siegelman was a victim of selective prosecution. (2) emails sent between jurors. (3)US Attorney Leura Canary alledged failure to abide by her recusal. (4)The government's a failure to report contact with jurors and US Marshalls. (5)The government engaged in prosecutorial misconduct.
Judge Fuller ruled Thursday the issues were the same as those raised by former HealthSouth CEO Richard Scrushy.
"When it was all said and done, his claims fail on their merits, just like Scrushy's did, and his motion for a new trial is due to be denied." Fuller said.
The U.S. Supreme Court refused to hear Siegelman's appeals. Siegelman faces resentencing August 3rd.
