A Jackson County man lost his appeal to keep his wife buried in the front yard of their Stevenson home.
Attorneys for James Davis said they filed a motion with the court on Monday asking to hold off removing her remains from their home until after the appeal is heard at the state court.
A judge ruled on Friday not to overturn her previous decision, which requires Davis to remove his wife's remains from the front yard of their downtown Stevenson home.
Both Davis and his attorney said they're not surprised by the judge's decision.
Davis said the judge is wrong, and it will require going to a higher court to prove that.
Davis buried his wife at their home citing it was her dying wish to be buried there.
The city sued Davis to have her removed, and the judge ruled in favor of the city.
Davis' attorney said he plans to file an appeal to the Alabama Court of Civil Appeals.
Davis said it's the end of the game that counts and predicts in the end it will be James Davis one, the city of Stevenson zero.
