MONTGOMERY, AL (WSFA) -
The future of the Rose Supper Club still hangs in the balance.
The court ruled club owners owed $1.2 million dollars to a man wrongfully beaten for stealing a woman's purse.
The judge said the club would close if owners didn't pay in time.
So far the judge hasn't pulled the plug on the Highland Avenue staple allowing all parties one last chance to work things out.
"We had a settlement negotiation with them [the owners]. They ended up at $25,000 dollars. We didn't think that was enough," says Landis Sexton, the plaintiff's attorney.
Sexton says it has been nearly six years since his client suffered injuries at the Rose Supper Club.
While sexton says he and his client aren't asking for $1 million dollars, they still believe the club should pay.
"We would take a lot lot less than that," says Sexton.
Despite multiple discussions with the Rose owners--per the judge's request--Sexton says they're unwilling to budge.
He filed garnishments against the owners and received roughly $20,000 dollars.
"The bank froze the money and will eventually pay it to the clerk's office and then to us," says Sexton.
He says that amount doesn't come close to what they're asking which means the next step is to go back to the judge.
"We're gonna ask her to sign the order that gives us possession of the club."
Sexton admits he doesn't want to close the club.
"That's the last thing we want to do. We simply want them to work out a payment arrangement that is acceptable to us and is a large enough amount."
WSFA 12 News contacted the club's owner who confirmed the money had been garnished from his account.
Additional comments were referred to his attorney who did not return our phone calls.
However, the attorney has said before he hoped his client would pay the damages.
WSFA 12 News also contacted the judge presiding over this case about when to expect a ruling allowing attorneys to seize the club.
She declined to comment.
