ATHENS, AL (WAFF) -
A convicted killer is asking a judge to impose a death sentenced. Andrew Lackey wants to drop his appeal and be put to death.
Lackey is on death row for murdering 80-year-old Charlie Newman on Halloween night in 2005.
Lackey went before Judge Robert Baker Monday in Athens. This hearing is to determine if Lackey fully understands the consequences of what he's asking.
"He was very clear in his testimony today that he would rather be executed than spend the rest of his life in prison," said Limestone County District Attorney Brian Jones. "He does not want to take the gamble that in the event that the court of criminal appeals were to reverse this and send it back, he is afraid that we will get this case ready for trial again that he would be sentenced to life without parole. He would rather stop all of his appeals now and be executed rather than having the possibility of being put in prison the rest of his life."
Lackey will not be given a competency examination.
He will now represent himself in the appeals process.
