Jefferson County Judge Houston Brown detailed in court document Monday that Birmingham Board of Education President Edward Maddox does not live in Birmingham, a key requirement for board members.
In the document, Brown states that Maddox "has actually resided for more than a decade at 5440 Carrington Circle, in the City of Trussville, Alabama. The Court does not credit his testimony that he and his wife seperated eight years ago."
Maddox had implied in previous interviews with FOX6 News that he and his wife were seperated and that he resided at a home on 53rd Street North in Birmingham while his wife lived in the Trussville home.
Maddox's residency was questioned during testimony related to two lawsuits filed against the Birmingham BOE by superintendents Dr. Craig Witherspoon and Dr. Tommy Bice. Judge Brown ruled in favor of Witherspoon and Bice Monday. The ruling confirms the state's authority to take over the Birmingham school system and as a result, protects Witherspoon's position as superintendent.
