Judge orders Chesterfield Marine's release from psychiatric facility

HOPEWELL, VA (WWBT) -

A Chesterfield Marine has been released from a mental health facility after a judge ruled there wasn't sufficient evidence of allegations made against him.

26-year-old Brandon Raub was committed to a mental health facility for 30 days after a series of events, including questions about his Facebook page.  

In court Thursday, the judge said the petition to keep Raub detained didn't list a single allegation against him. The judge also said the marine suffered a "deprivation of his liberty" by being held without a clear claim.

However, Raub's defense attorney admitted in court that during Raub's evaluation, mental health professionals found signs of "psychosis." Still, authorities couldn't keep him detained with specific reason.

Raub's mother spoke to NBC12 outside of court before she went to meet her son in Salem where he was being evaluated. Kathleen Thomas said, "This was an absolute fiasco but the truth has come out today. The judge saw the truth and it's an exciting day for America."

Raub's case went viral when a YouTube video of his arrest began circulating over the weekend. Supporters argued he should never have been taken in handcuffs and said he never belonged in a mental health facility. 

Of concern, were some posts on his Facebook page, like one on August 13 saying "Sharpen up my axe; I'm here to sever heads."

His legal team says that August 13 post isn't what it seemed.
