TUSKEGEE, AL (WSFA) -

The ballots have been cast, but questions still linger over the city elections in Tuskegee.  Attorney Lateefah Muhammad, fellow District 1 council candidate Brooke Moore-White and voter Leon Frazier have filed suit challenging the election.

They say the results in City Council Districts 1 and 2 should be thrown out.  Chris Lee won in District 1 and does face a runoff; Ala whitehead faces a runoff in District two on October 9th.

"People who did not have the right to vote were allowed to vote," Muhammad said. "And there were some that had the right to vote, but they did allow them to vote."  

The plaintiffs also allege election officials allowed people wearing campaign shirts to linger inside the polling place and also allowed voter guide ballots to lie on around on voter tables.

The city wants the suit dismissed. 

"None of the allegations, averments or facts contained in the Complaint rise to the level of substance to affect the election result," wrote City Attorney Milton Davis in a response filed in court.  "And therefore should not be considered in a municipal election's contest otherwise legal voters would be deprived of their franchise."

The case is set for a hearing on October 5th.
