During the hearing, Judge Putnam announced that a grand jury decided that afternoon to indict Britton on the charge of threatening the president.
U.S. Attorney Joyce White Vance issued a press release Wednesday afternoon saying Britton is charged with "knowingly threatening to kill, kidnap or inflict bodily harm on the president by tweeting the message, 'Let's kill the president. F.E.A.R.' on Sept. 14."
According to court documents, Britton first began tweeting threats against Obama in late June, allegedly saying, "Free speech? Really? Let's test this! Let's kill the president!"
After he tweeted a few other threatening messages, a Secret Service agent interviewed Britton in June and made him aware of the seriousness of the situation but did not take any further action.
Britton was arrested September 21 after his "Let's kill the president. F.E.A.R." tweet caught the attention of the U.S.S.S. Internet Threat Desk in Washington, D.C. He was charged by criminal complaint for threatening the president, according to Vance.
Britton's brother Corey and Corey's girlfriend Anne Carino requested to be third party custodians for Jarvis Britton. They said today in court they are willing to supervise Britton while he is on bond.
Judge Putnam says he will make a decision by 3 p.m. Thursday on whether or not Britton can be released from the Jefferson County jail into the custody of his brother and his brother's girlfriend.
