BIRMINGHAM, AL (WBRC) -

Harvey Updyke was scheduled to go on trial this week for allegedly poisoning the historic oak trees at Toomer's Corner, but it is not clear exactly when his trial will begin.

A judge has ordered that Updyke be evaluated at a psychiatric facility in Tuscaloosa to see if he is competent to stand trial. The problem is there is no space for Updyke right now.

Updyke's case won't move to trial until the evaluation is complete.
