AUBURN, Ala. (AP) - The Alabama fan accused of poisoning the trees at Auburn's Toomer's Corner has returned to Louisiana.
The Opelika-Auburn News reports that Judge Jacob A. Walker III granted Updyke's release from jail during a Wednesday hearing in Lee County Circuit Court. Updyke has completed a mental examination at Taylor Hardin Secure Medical Facility in Tuscaloosa to determine if he is competent to stand trial.
The ruling requires Updyke to live with his daughter, Megan, and leave the residence only during the daytime and for medical, legal or religious appointments.
Updyke has pleaded not guilty by reason of mental disease or defect to charges that include criminal mischief and desecrating a venerable object.
The judge set a Dec. 10 hearing on Updyke's competency.
