The victim in the case is identified as Tremain Gates, Jr. He's one of two children by Gates, Sr. The elder Tremain also has a daughter.
Gates was in court for a motions hearing. His attorneys presented nearly 20 of them to the court.
Some of the motions dealt with the constitutionality of the charge. Gates has been indicted on capital murder and the state is seeking the death penalty.
Some of the other motions dealt with specific evidence in this case. Judge Bill Bostick denied most of them, saying the requests were already covered under Alabama law.
Calera Police say on August 25, Gates was watching his son and when the child's mother came home the next day, she noticed the child wasn't feeling well and she took him to the hospital.
A few days later police arrested Gates and charged him with domestic violence. When the baby died in September, authorities charged Gates with capital murder, saying he threw his son against a wall and also dropped him on the floor.
