The University of South Alabama and its police chief are asking a court to dismiss a lawsuit filed over the shooting death of a naked student on campus.
Both the school and university police chief Zeke Aull claim they can't be sued under state law for the October shooting death of freshman Gil Collar.
A university police officer fatally shot 18-year-old Collar in October. The parents of the freshman from Wetumpka filed the suit over the killing last month.
Aull also asks a judge to refuse a demand that he arm all school officers with Tasers. He argues such a move would affect state budgets.
A judge has scheduled a hearing for Feb. 8 in Mobile.
