Probation officer accused of sodomizing man he supervised

TUSCALOOSA, AL (WBRC) -

A probation officer has been accused of sex crimes against the man he was supervising, Tuscaloosa officials say.

The probation officer, Michael Dwyne Burton, 36, was charged with custodial sexual misconduct for allegedly sodomizing a man assigned to him.

The victim claims that Burton went from kissing and fondling him to having sex in his office in just over a month.

Tuscaloosa police became involved when they were called to DCH Medical Center earlier this week, when the victim reported the sodomy, Captain Loyd Baker with the Tuscaloosa County Sheriff's Office said.

The 34-year-old victim told police that his probation officer had been touching him and trying to kiss him when he would check in at the probation office. Court documents say the first incident began Jan. 10 when the victim checked in to the probation office on 14th Street in Tuscaloosa.

The court documents allege that Burton fondled the victim during one encounter, tried to kiss him during a home visit and that Burton performed oral sex on him on Tuesday, Jan. 29 at the probation office. Investigators say the victim was able to back up his story with evidence.

"The victim has only been under his supervision since earlier this month. There have only been a few meetings up to this point. He came in to make an allegation after he had obtained audio recordings of the last meeting between the two," Baker said on Thursday.

Burton came in for questioning on Wednesday afternoon and was arrested at the sheriff's office on a charge of prohibited acts – custodial sexual misconduct. He was booked into the Tuscaloosa County Jail on a $15,000 bond and bonded out last night.

State law forbids parole and/or probation officers from having sex with anyone they're supervising whether sex is consensual or not.

Baker added that the victim was nearing the end of his probation period and may have felt to submit to Burton's advances or risk it getting extended.
