DEKALB COUNTY, AL (WAFF) -

One Alabama senator is proposing a bill that would keep any state or federal agent from infringing on Alabama's second amendment right to bear arms.

Since the talk of gun restrictions from Washington, there has been a large increase in gun permits and Senator Shadrack McGill said he's heard the cries of his constituents. 

"You know that second amendment has been there a long time, and I think it will stand, but if it doesn't, I'll take a stand with these gun owners and we'll stand on the courthouse steps and,  you know, tell the federal government to come on," said DeKalb County Sheriff Jimmy Harris.

Harris recently said he would stand up for county gun owners should the federal government seek to impose gun restrictions.

Now, McGill said he hopes to stand for all Alabamians with a bill in the upcoming legislature.

He said the bill would make it unlawful for any state or federal agent to try to enforce federal regulations on guns, ammo, or the manufacture of weapons in Alabama. The crime would be a Class C felony.

McGill said he's heard concerns from his constituents about encroachment by the federal government against a person's right to bear arms.

McGill said the following about the legality of such a law due to federal law overpowering state law:

"Yes, it does unless you have the United States Constitution in support of your state law.  Federal law does not trump our Constitution."

McGill hopes to include in the bill that if a citizen is arrested for refusing to comply with gun restrictions, that the attorney general of the state will represent them.
