Republicans have filed an appeal before the Alabama Supreme Court seeking to lift a Montgomery County Circuit judge's temporary restraining order on House Bill 84.
The appeal seeks to determine, "Whether the circuit court erred in entering a temporary restraining order prohibiting legislative officials from enrolling and transmitting a bill that has passed both houses of the Legislature to the Governor for his signature or veto, as those officials are required to do under the Alabama Constitution?"
Wednesday afternoon, Montgomery Circuit Judge Charles Price extended his restraining order until at least March 15, preventing the bill from being transferred to Alabama Governor Robert Bentley for his signature. Bentley is on record as supporting the bill and has said he would sign it.
Democrats and the Alabama Education Association filed a lawsuit Monday seeking a halt to the bill, which they called a "bait and switch" from a school flexibility bill to a school voucher program.
Democrats claim Republicans violated the state's Open Meetings Act in order to pass the bill. Republicans call Judge Price's order nothing more than judicial activism.
