The trial of former LSU running back Charles Scott got under way Tuesday.
Scott, 24, is charged with sexual battery. Authorities said an 18-year-old accused him of raping her at his Prairieville home in November 2011.
The accuser took the stand at 10 a.m. She testified she was allowed into Bogie's bar in Baton Rouge because she was with Scott. She said the bar allowed him to mix and serve her drinks all night. She added she was drunk when she left the bar with a guy friend and Scott. She also claimed she didn't know who Scott was, only that he used to play for LSU.
Prosecutors argued the under-aged accuser was served alcoholic drinks by Scott, who was a guest at Bogie's on Nov. 12, 2011. They said the teen was having consensual sex with a mutual friend that night and when the friend left briefly to use the bathroom, Scott entered the room and started having sex with her. They added Scott only stopped after she begged him to several times.
The defense told the judge there is no physical or scientific evidence showing Scott had sexual intercourse with the accuser. Scott's attorneys said she should have known their client was the guy she was initially having sex with because he is skinny and white.
"Charles Scott is a tank," one of the defense attorneys stated.
They argued while it was dark in the room, she could still smell and feel the difference between the two men.
Attorneys showed court surveillance video of the accuser and Scott interacting inside Bogie's and leaving with another guy in the parking lot. The judge was also shown pictures of the bunk beds where she told investigators the incident happened.
"This is a horrible crime," said Andre Gauthier, Scott's attorney as they entered the courthouse. "We have no comment on the case, but we look forward to the presentation of evidence."
"Our key witness is in the military," said District Attorney Ricky Babin when he arrived at court. "That's why we had to delay a month."
The case is before a judge in Gonzales. Scott's attorneys asked the judge to waive his right to a jury trial and the judge agreed.
