CINCINNATI, OH (FOX19) -

A judge ruled that Hustler publisher Larry Flynt cannot evict his brother from his store on Elm Street.

Larry Flynt filed a lawsuit against his brother in 2009, claiming he was infringing on his corporation's rights by continuing to call the retail shop on Elm Street 'The Hustler Store'. Larry reportedly hoped to evict Jimmy from the store completely.

Jimmy repsonded by re-naming it the 'Jimmy Flynt Sexy Gifts' store.

On Tuesday, a judge ruled that Jimmy Flynt has a valid lease at the Elm Street location.
