Contractor fined after demolishing vacant downtown gas station without permit

MONTGOMERY, AL (WSFA) -

A contractor has been fined for demolishing the old gas station at Bibb Street and Coosa Street in Downtown Montgomery without a permit. JB Waste pleaded guilty in Municipal Court, and received a $500 fine plus court costs.

The old station dated featured 1920s style architecture and was in the Lower Commerce Street Historic District, and all changes to structure within those districts are supposed to be approved by the Architectural Review Board.

Since a permit was not obtained, the city was not alerted a demolition was occurring in a special district, according to Deputy Mayor Jeff Downes.

"Since no permit was requested, the City could not react," Downes wrote in a statement to WSFA 12 News. "We are looking into further facts before determining how to react post-demolition."

Downes said the building was considered a safety hazard. The owner had requested the private contractor obtain a permit for the demolition, but the contractor had not.

"That's why these ordinances are in place, to protect irreplaceable resources," said Brandon Brazil, a member of the Architectural Review Board. "Once you tear down a 1920s gas station, it doesn't come back."

The space is currently being used for parking.
