BIRMINGHAM, AL (WBRC) -

A judge has refused to set bond for Joyce Garrard, the grandmother accused in the death of her granddaughter.

Six neighbors of Garrard testified during the bond hearing that they would be fine with the woman's release from jail, where she is currently held without bond. A doctor also testified about Garrard's history with heart problems, high blood pressure and sleep apnea. Circuit Judge William Ogletree sided with prosecutors, who had argued that bond is not allowed in capital cases under Alabama law.

Garrard's granddaughter, Savannah Hardin, died after she was forced to run as punishment for eating a candy bar.

Currently, Garrard is awaiting trial.
