JEFFERSON COUNTY, AL (WBRC) -

The uncle of a four-year-old boy who found a gun and accidentally shot himself in the head Friday afternoon has been charged in the case.

The boy's 21-year-old uncle, Marquis Rashad Abernathy, has been charged with reckless endangerment and receiving stolen property. He turned himself in to police Wednesday afternoon.

Brighton police say a loaded gun had been left in a back bedroom of a home in the 4100 block of 7th Avenue. Four-year-old Davion Abernathy was accidentally shot in the head while playing with the gun around 4:30 p.m. Friday, May 3.

Davion Abernathy was transported in critical condition to Children's of Alabama where he is still recovering.

Police say adults were inside the house at the time of the shooting.

"I spoke with Mr. Rashad. He was at the residence earlier that night, spent the night," Brighton Police Lt. Ray Hubbert said. "When he left the residence...he left a loaded handgun where anybody could get a hold of it not knowing children would be there. His sister brought kids to the home, and they went in to the bedroom and got a hold of it."

Investigators also discovered the gun was reported stolen out of Jefferson County.
