Man accused of killing 10-week-old baby

The Lafayette County Prosecutor has charged the father of a 10-week-old baby with her violent death.

Alex Anthony Gilbert, 24, of Independence, was charged with second-degree murder. His daughter died four days after she was rushed to the hospital.

An autopsy revealed the baby had brain damage from a skull fracture. In addition, the child had broken bones and contusions, including to her lung. She had fresh and old injuries.

Gilbert made his first court appearance Thursday morning and entered a not guilty plea.

Bond was set at $500,000. If Gilbert makes bond, the conditions of his bond include no contact with anyone under 17 years-old.

According to court documents, Gilbert in recent weeks had been seen tossing his daughter into the air and was warned not to do so. The baby had old rib fractures that could have resulted from this, police said.

The baby's mother allegedly told police that her daughter had bruising on her bottom that Gilbert claimed occurred when he had bounced his daughter up and down on her knee.

On Friday, Gilbert allegedly said his daughter was "moody" and told the baby's mother that he could just "throw the baby up against the wall," according to court documents.

Gilbert and the baby's mother were apart when the little girl, known in court records as BMG, was born on March 5. In recent weeks, the couple reunited and were apparently living with the baby's maternal grandparents.

After the baby was rushed to the hospital, Gilbert allegedly made incriminating statements including, "I need to hire an attorney" because "they are going to blame someone for this," according to court documents. He also reportedly said he would take the blame for the girl's injuries. Gilbert reportedly said, "I'm sorry" to the baby and repeated this to her mother when doctors brought them into the baby's room and said she was brain dead.

Pictures show the baby was fine on Thursday. Her father was solely responsible for her care for about an hour Thursday night, according to court records. She was apparently in distress after that and her condition worsened on Friday after she was again in her father's care.

After she had trouble breathing, her frantic mother sought help from her father who called authorities.

"It also should be noted that Alex was angry that the mother of the infant had left for any period of time and when she returned, they argued and he punched her in the ribs," according to police. "I observed the mother at the hospital and she also had black eyes and a bruise to her forehead."

She allegedly told police that she was bruised after Gilbert smacked her in the face with a phone.

"Witnesses and family members report that Alex is a very possession person and any time (the baby's mother) is not with him, he becomes very angry and accuses her of cheating on him and sleeping with other men," according to court records.

Gilbert told police that the mother of his child's injuries were from an accident. When the woman left the bedside of her daughter, a nurse spotted Gilbert going through the woman's text messages on her personal phone, according to court records.

If convicted of killing his daughter, Gilbert could face life in prison.
