Supreme Court: Elmwood Place case may proceed under current judge

COLUMBUS, OH (FOX19) -

The Ohio Supreme Court has ruled that the battle over speed cameras in Elmwood Place may proceed under the current judge.

The Village filed a motion asking that Hamilton County Common Pleas Judge Robert Ruehlman remove himself from the case. 

The motion charges that the judge showed bias and prejudice in the case when he ruled the cameras unconstitutional.

A ruling filed Tuesday by the Ohio Supreme Court denies the motion, allowing the case to proceed before Judge Ruehlman.

"The statutory right to seek disqualification of a judge is an extraordinary remedy," the ruling reads. "A judge is presumed to follow the law and not be biased, and the appearance of bias or prejudice must be compelling to overcome these presumptions. Those presumptions have not been overcome in this case."
