Former Lee Co. Disc Jockey given new, tougher prison sentence

AUBURN, AL (WSFA) -

A former Lee County radio personality has been sentenced for a second time after being convicted of having deviant sexual intercourse with a child under the age of 12. 

Originally, Clarence Whatley, the former Eagle 95.9 WGSI Disc Jockey, was sentenced to about five years in prison - this happened back in March.

The state objected to Whatley's sentence saying it was too lenient, and furthermore, illegal. Prosecutors were pushing for a 20 year sentence.

The judge upheld the state's objection and re-sentenced Whatley on Friday morning to 21 years in prison for sodomizing a child under the age of 12. Prosecutors say the victim was under 7-years-old.

Whatley will be expected to serve at least 85% of that sentence. Throughout all court proceedings, Whatley has maintained his innocence.
