CLEVELAND, OH (WOIO) -

19 Action News Reporter Ed Gallek has learned no charges are being filed against a driver for hitting and killing a man helping another driver stranded on I-90.

Back in May, Earl Loury, 50, died while acting as a Good Samaritan. Loury and his passenger were pushing a stranded mother's car out of the way when another driver plowed into Loury's car and the woman's car. Loury was hit and killed.

Cleveland City Prosecutor Victor Perez tells 19 Action News, "There was no evidence that the driver of the car committed any crime or traffic violation."
