Lawyer: Former soldier has paperwork to prove Purple Heart award

CHEROKEE COUNTY, GA (CBS46) -

A retired Army sergeant accused of lying about his receipt of a Purple Heart award claims to have paperwork to validate his receipt of that award, according to one of his lawyers.

Attorney John Cook said Sgt. Shane Ladner served in Central America in the early 1990s and was wounded in action during that service. The details of the military action are classified, according to Cook, who showed paperwork that he said validates that account.

"He does have a Purple Heart," said Cook.  "Shane was injured during an operation that he's not at liberty to discuss because of his oath and his contract with the U.S. government."

Ladner has been charged by Cherokee County investigators with four counts of theft by deception, one count of false swearing and one count of a false statement to a police officer in connection with his receiving free Purple Heart license plates for his vehicle. In order to receive those license plates, Ladner had to swear he was as Purple Heart recipient.

While Cook furnished a copy of military paperwork from 2004 that showed Ladner's honorable discharge and Purple Heart award receipt, Cherokee County investigators said the United States Army has no record of those discharge papers proving the receipt of that award.

According to the district attorney in Cherokee County, a grand jury will convene likely at some point this summer to vote on whether or not to hand down indictments on Ladner.
