INDIANAPOLIS (FOX19) -

Hamilton County Prosecutor Joe Deters says he will seek the death penalty against a man who is accused of murdering the owner of a local pizza place.

John Deloney, 27, was arrested on Wednesday in Indianapolis after an manhunt resulted in him turning himself in at Indianapolis Police headquarters on an open warrant for aggravated murder.

The warrant was issued on Tuesday. Deloney is accused of murdering Richard Evans, 50, at Cosmic Pizza on Woodsdale Avenue on Saturday evening.

During a press conference on Friday, Deters released surveillance images of a man appearing to be Deloney inside the restaurant. In one of the images, the man is seen pointing a gun and Evans' wife can be seen crouching down in the background.

Investigators say Deloney entered the store and place an order for food. He then produced a handgun and demanded money. Evans and Deloney struggled for the gun and Evans was shot at close range. After being shot, Evans attempted to escape from Deloney, but Deloney continued to follow him and shoot three additional times. Evans exited the restaurant and made it to a front yard adjacent to his establishment, where he died.

Deloney's wife and children, who were in a back play area, were not injured.

"This cowardly act of hunting down an innocent unarmed man in front of his wife and family deserves nothing less than execution," said Deters. "That will be our goal."

Deloney is being held without bond at the Marion County Sheriff's Office. Once the extradition process is complete, he will be transferred to Hamilton County for prosecution.

Neighbors have been rallying around the victim's family.

Sarah Cody, who lives down the street from Cosmic Pizza, is breathing a sigh of relief now that Deloney has turn himself in, saying the murder hasn't shaken her sense of security.

"I feel safe. I mean this is a very quiet neighborhood. This is the first thing that's really happened since I've been here in two years, and unfortunately, things like that can happen anywhere now, but I feel safe here."

Dawn Murray is a neighbor of the Evans and tells FOX19's Gordon Graham she plans to follow the case every step of the way to support Evans' widow.

"It's important because I've seen first hand the effect it's had on the family, and I don't know if she will or will not have the strength to be there, so I want to make sure that we are."

Evans was a father of three children. His funeral visitation will be at Hodapp Funeral Home, 7401 Vine St., Carthage, Friday from 11 a.m. until blessing at 1 p.m.
