(FOX19) -

Ryan Widmer's attorney is asking the United States Supreme Court to hear an appeal in his case.

Widmer was convicted in 2011 of drowning his wife, Sarah, in the bathtub of their Warren County home.

His attorney Michele Berry is asking the high court to consider whether the bathtub in the case was illegally seized, and if 'body part impression' testimony should be thrown out in the case.

The justices will decide if they'll hear the case in September.
