NY restaurants sued over automatic gratuity

Going to your favorite restaurant might be getting more expensive.

It's because gratuities are now being added to your bill at some New York restaurants. 

Tipping, while customary, is not mandatory in New York City.

According to the Department of Consumer Affairs, restaurants can only include automatic gratuity charges for parties of eight or more. 

But, a CBS News report found that some restaurants are tacking on a 17 percent gratuity to every check. 

Now, Applebee's, Olive Garden and Red Lobster are all being named in a $5.5 Billion class-action lawsuit claiming deceptive billing practices.
