ATLANTA (CBS ATLANTA) -

A tense and emotional custody hearing wrapped up in Fulton County Superior Court around 4:45 p.m. 

The judge denied the emergency request for change of custody.

Usher's ex-wife, Tameka Raymond, filed for the emergency hearing after the pair's son nearly drowned at his Atlanta home on Monday. 

Usher and Foster Raymond arrived in the courtroom around 2 p.m. just before the hearing was scheduled to begin.

By 2:25 p.m., the hearing had not started as attorneys first met in Judge John Goger's chambers. Shortly after they returned to the courtroom, Tameka and her attorneys left the courtroom for ten minutes.

Foster Raymond's attorney said the hearing is not because her 5-year-old son nearly drowned in his dad's pool.

According to her attorney, Angela Kinley, Foster Raymond is concerned that Usher Raymond IV doesn't spend enough time with their children and allows family and caregivers to take of their 4- and 5-year-old sons.

Usher was just awarded full custody of the children last year after a very messy divorce.

Kinley said long before Foster Raymond's son nearly drowned in his father's northwest Atlanta pool, Usher's ex-wife had already petitioned the court for a modification to the custody arrangement because she claims Usher spends the majority of time traveling for work.

"What we really want to stress is she's not assigning blame to anyone for this situation. This situation did not perpetuate the filing of the action. There is a petition that was filed previously. This just solidified some of the concerns she had previously," said Kinley.
