The owner of a home in Huntsville's Five Points community wants a jury to decide if the home can be torn down.

A lawsuit filed against the Huntsville Historic Preservation Commission and the City of Huntsville states the Commission will not allow the homeowner to remove the structure.

A tornado damaged the home on Ward Avenue in 2010. According to the lawsuit, homeowner Sam Citrano presented his case to the commission multiple times.

The lawsuit states the structure is a safety hazard and that it will cost more than $200,000 to make repairs.
