A Butler County family can't believe that the man convicted of their loved one's death has been allowed to leave prison and work near where they live and where the crime happened.
One of the big arguments that came up during today's hearing is whether McConico should be charged with a capital crime in this case.
Sara Mitchell's family first reported her as a missing person. It was later determined that her McConico, her boyfriend, had killed her, dumped her body in a dumpster outside a drug store in Oxford and then driven to Georgia where he was eventually arrested.
Monday in court, the lead detective on the case reviewed the statement McConico gave police. He says he and Mitchell were at a friend's house when they got into an argument over her communicating with another guy.
The argument led to a fight where both were on the ground throwing punches. McConico says at some point, he punched Mitchell in the face and ribs and when she didn't move, he panicked, put her in the trunk and drove away.
Later that evening, when he got to their home, he checked the trunk and she was dead.
After dumping Mitchell's body, McConico drove to Georgia where he called his sister and told her what he had done. A short time later, authorities arrested him.
Monday, McConico's attorney questioned the state's evidence saying they did not have enough to support a capital murder charge.
"And he told the detective at all times he never intended to kill this young lady...that she was the best person he'd ever met and there's not intent. So they knew that," Emory Anthony said.
Even though Judge Tommy Nail bound the case over to the grand jury on the capital murder charge, he did reduce McConico's bond.
He was being held on no bond. It's now set at $250,000.
