Arizona AG Tom Horne: Clemency board isn't biased

State prosecutors say there's no evidence that the Arizona Board of Executive Clemency is biased and a death-row inmate will get a fair and impartial hearing.

Lawyers for Edward Schad filed a lawsuit in federal court last week seeking to postpone his scheduled Oct. 9 execution.

They've also asked four clemency board members to recuse themselves from Wednesday's scheduled clemency hearing in Florence.

In a response to the court Monday, Arizona Attorney General Tom Horne says the allegations against the board are unsubstantiated.

The 71-year-old Schad was convicted in the 1978 killing of a Bisbee man.

His scheduled execution last March was postponed when the U.S. Supreme Court denied the state's request to lift a lower court's order blocking the execution. The high court reinstated Schad's death sentence in June.
