STEVENSON, AL (WAFF) -

The Alabama State Supreme Court denied a man's appeal to keep his wife's body buried in the front yard of his Jackson County home.

James Davis buried his wife, Patsy, in the front yard of his Stevenson home in 2009, despite objections from the city council.

The city sued and a circuit judge ruled that Davis remove remains. Davis and his attorney appealed that decision, maintaining that the city never adopted regulations regarding cemeteries.

The State Supreme Court denied the appeal on Friday.

"I've told them that my wife asked me to put her there," said Davis. "I put her there and I'm not going to allow them to come in my yard and take my wife out. If they come in, I have to protect what's mine."

Stevenson City Attorney Parker Edminston said the city will attempt to seek a civil resolution asking Davis to remove the remains.
