Arrest procedure questioned after Galaxy Way shooting

Why is a corrections officer accused of shooting and killing a man not in jail? He turned himself into police the day after the shooting but has not been arrested or charged.

Police said the victim, Jason Lewis, was shot multiple times.

The shooting happened almost a week ago, at Twickenham Village Apartments on Galaxy Way in Huntsville.

The accused gunman, Jeremy Primus, a corrections officer at the Madison County Metro Jail, claims it was self defense.

Many have asked if there is more to this; is this special treatment? And, would a civilian be in handcuffs already?

We took those questions to Madison County District Attorney Rob Broussard.

The investigation continues behind the shooting; it will eventually be handed over to the District Attorney's Office, where it will be reviewed and if there is just cause, it will be presented to a grand jury.

Broussard said, every citizen does have a right to protect themselves from unlawful deadly force and everyone is treated exactly the same.

"I don't care what somebody does for a living, what their occupation is. What they have done, and if that includes taking someone's life, it will stand on it's own facts and we will carefully review it and we will see that justice is done," added Broussard.

Justice could come in the form of an arrest or whether the death was justifiable as self defense.
